The regulation « About safety of wheel vehicles », which was approved by the Governmental order of the Russian Federation 720 from 10.09.2009 (details in «ÊÒ» 8/2009) had hardly come as in bowels of Ministry of Industrial Commerce changes are being prepared for it which also will be approved by the corresponding governmental order of the Russian Federation have started to prepare has not had time to come into force. Among authors of amendments are NAMI, GASROM and other interested persons. In Internet except for criticism of " the first edition » from private persons, specialists and mass-media it is possible to find objections of independent lawyers as well. It appears that the initial document was accepted in the form of a governmental order, instead of a federal law. The similar mechanism does not demand a wide discussion by the deputy body in view of voters' opinions, labor unions and other public organizations, manufacturers of technics and representatives of motor transportation enterprises of any patterns of ownership. And this is in spite of the fact that its acceptance had touched the rights and legitimate interests of all citizens and the juristic persons of the Russian Federation who already have vehicles on the property right (TC).
Some details of the proposed changes:
· The permited length of lorry convoys from TC, categories of M and N with trailers (semitrailers) can be increased up to 20 meters (in « the first edition » accordingly 16,5 and 18,75);
· It is supposed to limit the requirement of obligatory russification of all information and warning inscriptions only with the obligatory russification of the program of an onboard computer;
· Use of digital (and not just hand-like) speedmeters is authorized;
· New addition: now tachographs (means of control over observance of drivers in modes of movement, work and rest) any trucks and buses, including mini-vans should be without fail equipped: read – even fixed-route taxis;
· It is offered to concretize the list of TC which should be without fail equipped with hardware of satellite navigation GLONASS or GLONASS/GPS. The matter is that in the previous edition this requirement dilatedly concerned even cars, down to personal ones – they also "feasibly" are engaged in transportation of passengers;
· The equipment of all the TCs with seat belts is offered to replace with aw categorical requirement hich is rather ambiguously readable proposal: « the vehicles structurally intended for the equipment of seat belts, must have them »;
· The state checkup (GTO), it seems like, all the same remains under the juristiction of the Ministry of Internal Affairs of Russian Federation for the state control (supervision) is assigned to this structure over TCs which are operating. The tool is familiar – GTO.
It’s understood that this is still yet a project. But let us wait till the final edition. But the fact that it’s not the first time that documents of such level and importance are being re-checked and corrected, some how alerts.
